International tax law
Investments by German companies abroad and the expansion of foreign investors into Germany have one thing in common. Property owners with assets in another country also have the same thing in common: international tax law. On the one hand, it is contained in national laws, in our case mainly in the Income Tax Act and the Foreign Tax Act as well as in inheritance tax law. On the other hand, it is contained in bilateral agreements for the avoidance of double taxation, the DTAs or double taxation agreements. There are three main objectives: How to minimize the tax burden on current income, how to optimally offset losses against profits for tax purposes, how to transfer profits from one country to the other, and how to get out of the foreign country with as little tax damage as possible. For private succession, it is extremely important to know how differently gifts and inheritances are taxed in Germany and abroad. This is the basis for long-term planning, both for expansion and investment, but also for transfer, succession and withdrawal.
What are the special features of international tax law?
The decisive factor is the so-called world income, which the state in which you are resident wants to know and tax from you. After it is clear in which countries you are subject to tax, there is a special feature: not everything is included in the double taxation agreements, certainly not in the case of inheritance or gifts. Many special features are contained in national regulations. There are documentation obligations (e.g. transfer prices), deadlines and information obligations that must be observed.
